Terms and Conditions


Unless prior arrangements have been made, Check in time is after 4 p.m. and check in time is at 10 A.M.  NO late check-out unless prior arrangements are agreed upon in writing.


Please note each property has a maximum number of guests. If Guests have over the maximum number of persons stay at the Villa, there will be an additional charge per night for each additional person.  


All units are NON SMOKING;

Pets are not permitted in the Villa under any conditions;

Please do not move furniture, TVs or artwork from its location;

Please be aware that loud music is not allowed in the residential area of the resorts.  Be considerate of the neighborsafter 10pm, music must be kept at a low level.  After 12am, music must be turned off completely;

Beach properties: Beach sand must be washed off before entering the Villa and/or the pool, otherwise Guest will incur additional maid service expenses.

If renting a golf cart at the resorts, because cart keys can be easily substituted, and due to the high number of carts reported stolen or appropriated by minors, please secure the cart with a padlock at all times when not in use.

Please do not hang towels or clothes from the balconies or terraces.



A damage security deposit may be required for some properties. The deposit is NOT applied toward rent; however, it is fully refundable within ten (10) days of departure, provided all the following provisions are met.

a. No damage is done to Villa or its contents, beyond normal wear and tear.

b. No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay. 

c. All debris, rubbish and discards are placed in dumpster, and soiled dishes are placed in the dishwasher and cleaned. 

d. All keys are left either on the kitchen table or the lock box at the entrance and Villa is left locked and all A/Cs and lights turned off. 

e. All charges accrued during the stay are paid prior to departure.  

f. No linens are lost or damaged. 

g. NO late check-out. 

h. The renter is not evicted by Landlord (or representative of the Landlord), the local law enforcement, or Resort security. 

i. No damage is done to the golf cart and Guest or his guests have not incurred any liability or damage with the Resort. (Applicable for guests renting golf carts at Palmas del Mar Resort). 

j. If Golf cart is provided with the rental, please fill the tank with gas prior to checkout. Otherwise, a fee of $25 will be charged.   The carts may be gassed up at the Yacht Club Marina. (Applicable only to Palmas del Mar Guests



A forty five (45) day notice is required for cancellation. Cancellations that are made more than forty five (45) days prior to arrival date will incur no penalty. Cancellations or changes that result in a shortened stay, that are made within 45-30 days prior to the arrival date, forfeit 25% of the payment and damage security deposit; if within 29-15 days prior to the arrival date, forfeit 50% of the payment and damage security deposit; if within 14-7 days prior to the arrival date, forfeit 75% of the payment and damage security deposit.. There will be no refund of rent or deposit for cancellations made 6 days or less prior to arrival or early departure other than as set forth above. In the event of cancellation or early departure once the Term has commenced, there will be NO refund of payment or deposit. 



While linens and bath towels are included in the unit, daily maid service is not included in the rental rate; however such daily maid service is available for an additional rate. We do not permit bath towels or linens to be taken from the units.


Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.



Guest shall allow Landlord access to the property for purposes of repair and inspection.  Landlord shall exercise this right of access in a reasonable manner and provide Guest with advanced notice. 



Any exceptions to the above mentioned policies must be approved in writing in advance.



No refunds will be given unless:
a. The National Weather Service orders mandatory evacuations in a "Tropical Storm/Hurricane Warning area" and/or

b. A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest. The day that the National Weather Service orders a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund: 

1. Any unused portion of rent from a guest currently registered, 

2. Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the Hurricane Warning is lifted; and 

3. Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period.



Landlord is not responsible for any accidents, injuries or illness that occurs while on the Villa premises or its facilities. Landlord is not responsible for the loss of personal belongings or valuables of Guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.  Guest hereby agrees to indemnify, defend and hold Landlord harmless from any and all claims or assertions of every kind and nature incurred during Guests stay at the Villa. 



This Agreement shall be governed, construed and interpreted by, through and under the laws of the Commonwealth of Puerto Rico, and venue shall lie in the state or federal courts situated in the Commonwealth of Puerto Rico.  Guest hereby waives any conflict of law principles which may be present and expressly consents to the personal jurisdiction of the Commonwealth of Puerto Rico for any lawsuits arising out of or under this Agreement. 



The covenants, obligations and conditions herein contained shall be binding on and inure to the benefit of the heirs, legal representatives, and assigns of the parties hereto.



No indulgence, waiver, election or non-election by Landlord under this Agreement shall affect Guests duties and liabilities hereunder.



Should it become necessary for Landlord to employ an attorney to enforce any of the conditions or covenants hereof, Guest agrees to pay all expenses so incurred, including a reasonable attorneys' fee.


The parties hereby agree that this document contains the entire agreement between the parties and this Agreement shall not be modified, changed, altered or amended in any way except through a written amendment signed by all of the parties hereto.
